1. Who we are

LivingWill is a software product of Praethos, a limited liability company. LivingWill is not a law firm and does not provide legal advice. Use of the platform does not create an attorney-client relationship.

2. Your account and your keys

You are responsible for your passphrase and your recovery phrase. We never see either. If you lose both, we cannot restore your vault, and no one else can either. That is the design.

3. What we promise

We commit to a 180-day notice of any intent to close the service. We commit to quarterly encrypted-vault escrow with Iron Mountain. We commit to publishing the open-source decryption tool. We commit to an annual transparency report after one calendar year of operation.

4. Subscriptions and one-time services

Subscriptions renew on the anniversary of purchase unless cancelled. You may cancel from the account dashboard at any time. One-time services (AI draft, attorney review, remote online notarization, physical wet-ink storage) are charged once at point of sale.

5. Refunds

Subscription refunds are available within fourteen days of purchase, less any one-time services consumed. Attorney reviews are refundable up until the attorney begins the review.

6. Acceptable use

Do not use the platform to plan or execute anything illegal. Do not impersonate another person. Do not attempt to access someone else's vault without proper authorization through the posthumous access workflow.

7. Limitation of liability

Our liability is limited to the amounts you paid in the twelve months preceding any claim. We provide the platform on an as-is basis. State-specific templates are attorney-reviewed but use of the templates is at your own decision.

8. Dispute resolution

Disputes are governed by the laws of the State of the United States. Disputes are resolved through binding arbitration administered by the American Arbitration Association, with a small-claims carve-out and a class-action waiver. The detailed arbitration clause is in the full Terms.

9. Changes to these Terms

We may update these Terms. Material changes are notified by email at least 30 days in advance.
